I have a tenant who paid a deposit in 2002 at the start of a 6 month AST. The tenant has remained in the same property with no changes to the agreement. Will the deposit need protecting under the new legislation. If it does can I just let him have the deposit back now instead of registering?

I have another tenant with an original AST from 1999 with a deposit held. A new agreement was issued in 2010 with the original deposit from 1999 being held. Should the original deposit have been registered? If so can I just return the deposit now rather than registering.
