evicting tenants and the bolier needs changing

i've an interesting coincidence i'd like your opinion on.

i'm in the process of evicting a tenant.

during this year's corgi check done yesterday, the property needs a new boiler. Plumber can't get to it for two weeks. Changeover will take 2 days. In the meantime the boiler's failed it's corgi.

with a tenant i'm getting on with, i'd obviously resolve this by not charging for rent and asking that they not use the boiler (not really a prob at moment with nice weather, also there's an electric shower) until it's replaced. But where do i stand with a tenant who i'm in dispute with (and who's not paying rent)? could he report me to the council re minimum housing standards? could he say i'm harassing him for turning off the boiler?

your opinions would be much appreciated
