Hi

I have a problem tenant who has been consistently late with rent over the last year. In January, we agreed that I should issue a Section 21 as he was unemployed and unable to pay rent. However, during the 2 month notice period he has become more and more aggressive and difficult. He is now claiming he never received the Section 21 (although I do have a witness who was with me when I delivered it) and we have talked about it on a number of occasions on the phone. At this stage he is still over 2 months in arrears.

I now find him so aggressive and threatening to talk to that I have asked for communication on paper only. Because of his actions I really want him out of the property but he is refusing to move out saying that I am at fault with the management of the property. Minor issues with the property that we have sorted out amicably before now he is now exaggerating and saying were major due to our neglect. For example, there was a small leak in one of the upstairs radiators which was fixed the same day but now he's saying there was water flooding through the downstairs wall. The drains blocked in the street which was sorted out by the water board, but he's saying we're at fault because we didn't book a plumber - even though he told us of the problem and the fact that it was solved by the water board on the same day!

Anyway, my question is will this affect me enforcing the Section 21? I feel I am being bullied by him - I have tried to be reasonable but he's throwing every effort I make back in my face. Any advice would be much appreciated.

Many thanks

H Chester
