Hi

I have a tenant who is being evicted under Section 8.
I have a court order for eviction on 16th November and he has not left.
I have issued a N325 warrant for possession and have a bailiffs appointment for 11th december.
I have been informed that my tenant has applied for a stay of eviction through the courts and he has a hearing date of 5th December 2007. I am unable to attend this hearing.
If I do not attend what is the likley outcome ?
If he is granted an extension my understanding is that he can get a maximum of 6 weeks extension from the original date of eviction (16th Nov). This would take him up to 28th December.
Can I apply to the bailiffs to postpone the date to a suitable date in early January or do I have to wait and see if he moves out on 28th December and then re-apply to the bailiffs ?
I am assuming the fee for the bailiffs will be either re-paid if he gets an extension and leaves prior to the date or used for the future eviction.
