Interest payment on rent arrears

Hello Dave,
At a hearing for re-possession in November the judge ordered that the Tenant should leave within two weeks and also pay the rent arrears. We assumed that 8% interest could be claimed on top as it goes back to May 2007. This interest amount was added to the final rent statement which was sent to the Judge and Tenant one week before the hearing.

However the judge has only ordered payment of arrears but no interest included.
I wrote in and queried this and was told that because interest was not written on the original particulars of claim then it cannot be added. I've looked at the original sheet and there is no box or area on the form asking for interest to be put down?

Can we query this decision not to add it?
