From what I understand when an AST expires the tenant and LL have the option to sign a new AST or continue on a rolling month by month tenancy under the rules set out by the original AST.

If this is the case, and assuming that in both cases the tenant needs to give 1 months notice before leaving the property and the LL 2 montha notice before getting the property back why, does anyone sign a new AST? Surely the conditions are the same?

Also, if an AST is agreed and signed can the tenant give notice that they wanted to leave 1 month in to a 6 month tenancy or do they have to wait for the AST to expire?
