Buying property with sitting tenant

A landlord has approached me to set up a 4 month agreement for a property that he is purchasing where there is a sitting tenant, I have explained that this would need to be an AST with a minimum of 6 months etc but I have been informed that the current vendor has not issued a section 21 notice to the tenant and has now become a periodic tenancy. How does this work, will the names on the current AST need to be transfered to the new buyer by a solicitor or is it best to set up a new AST?
