Hi, My tenants correctly gave notice and moved out on 31st August 2012. New tenants moved in on 1st September 2012. The local council are charging me for a days council tax for the 31st August.

The council state that in the legislation, council tax is due on a daily basis. They continue that since the vacating tenants could not have occupied the flat for the whole of the 31st payment becomes the landlord's responsibility.

Is this the case?

For example if notice was given and the tenants actually vacated on say 15th August the tenants would still be liable for council tax until end of the month.
