I have just had a tenant move out after 3 years and he has left the carpets in 3 rooms and stairs very stained. I have had them cleaned but some of the oil/paint stains wont come out. I have contacted him regarding this and he is resisting all efforts to pay for replacement of the carpets saying that it was wear and tear.I have "after" photos but no "before" as this tenancy started before I wised up to the need for photos!

The cost of replacement carpets (not including underlay and gripper which we can reuse) is £1095. The deposit I have lodged with DPS (groan!) is only £620

Am I sunk?
