Evicting a longstanding tenant

I need to evict a longstanding tenant who moved in before the deposit protection scheme was brought in. They are on a periodic tenancy and there has been one rent increase. Is it true that you can't use a S21 if the deposit isn't protected even though the scheme doesn't apply to this tenancy? Does anyone know if a precedent has been set?
