Deposit not registered!

Landlord forgot to register deposit.

If tenant signs note that deposit can be used for rent, would that preclude them from requesting 3x deposit as you only used as rent after the time that should have been registered.

Same question if you return the deposit [as they wont sign that you can use as rent!].
