With a group of other leaseholders we took the freeholder to RPT in 2010 and the service charges were deemed not payable as they had not been demanded properly. Following the decision we didn't believe that the service charges had been demanded properly since then and again took the freeholder to RPT in 2013. The RPT upheld that the 2010 decision had not been met and the previous service charges were not payable, but also that the most recent service charges were also not payable. How long do they have to try and demand them correctly before it is out of time and they become unrecoverable?
