Deposit withholding by Letting Agent

One of my Tenants has served notice as she has obtained a council property.
My letting agent has told her she cannot reclaim her deposit as her contract says once paid the agent has it for 'life' to save her leaving the agency then returning top rent again.
I believe the letting agent has no power to do this and is unreasonable in his action.
I am trying to help my tenant recover her deposit subject to leaving my property in a good condition similar to when she moved in.
On what grounds can my tenant recover her deposit please despite signing a contract which specifically states she cannot recover the deposit?
