If I was to go to court which rate of interest do I choose...

1) RLA standard AST - The interest rate is 3% above the base rate used by the RBS

2) RLA County Court info - If you wish you can claim interest. You need to state in the Particulars of Claim “The claimant seeks interest under S69 County Courts Act 1984 at the rate of 8% per annum from (date money was owed to you) to (date you are issuing the claim) in the sum of £ xxx and also interest at the same rate up to the date of judgment or earlier repayment at the daily rate of £ yy.” The daily rate of interest is calculated by multiplying the amount of claim by 0.00022.

So is it the Tenancy Agreement rate (RBS base rate + 3%), or does S69 override with 8%
