Does council have to make interim payment after 8 weeks even if they have not yet looked at HB claim?

Some councils now have a backlog of about 3 months before they look at claim to consider paying.

I seem to recall that councils must make an interim payment after 8 weeks.

Is this correct?
Where can I find this law, so that I can complain to council?
