I have a property with tenants (on a stat periodic tenancy) who are always late with their rent, so after many warnings I had given 3 months notice to leave (end April). The tenants asked me for more time and I agreed they could stay until July as long as the rent was paid on time during that time. On 30 January they informed me that they would be moving out on 1 February (2 days notice). The tenants left the property on 1 Feb without cleaning it or repairing any damage left and they are now refusing to pay rent for February. Their tenancy deposit barely covers the rent for February and cleaning. Can I legally keep the deposit to cover this so that I can get the property ready to re-rent? Any advice would be appreciated.
