Dear Sirs
Pls note one of our tenants is currently in prison.we were informed of this by one of his associates.
The tenant was in receipt of housing benefit and the council has stopped paying the rent. The council has not advised us of the reasons for not paying the housing benefit.
The tenant has not advised us when he will be freed from the prison and we have no indication of his release date.
We did issue a SECTION 21 Notice terminating the tenancy on expiry and this notice expires on 8.11.2008 which is the the date the tenancy also expires.
Can you pls advise us if we can take possession of flat immediately and on what basis.Pls also advise if the tenant can in future bring any action against us for unlawful eviction.
