My agent did not regtister a deposit

I have a dispute with my former tenant over damage to my property, which totals more than the deposit paid. I used an agent, who took one months rent from the tenant. The agent sent the necessary paperwork to the TDS, but have now informed me that the deposit was not registered correctly onto the TDS system and they are refusing to arbitrate on the claim. They have offered me half the deposit “as a gesture of goodwill”.

How do I stand legally, and what’s my next move?
