Last week I submitted an MCOL claim against my tenant and her guarantor. The tenant has made an offer to pay over time which I have a mind to accept. I will accept the offer to pay but have the arrangement ratified via the Court. I have had no response yet from the guarantor and suspect that I will not get a response.
My issue is that on the MCOL site there does not appear to be the option of accepting the offer from the tenant but continue with the judgement against the guarantor who has not acknowledged the claim. Do I need to get some form of acceptance of the arrangement to pay from the guarantor or do I just proceed with accepting the offer of an arrangement to pay from the tenant.
Or, when I accept the offer and it is subject to a judgement of the court, does that implicitly include the guarantor.
