I picked up the Letting Agent from a FB advertisement and let him manage my portfolio of Four Properties. He was not doing his job but collecting a fixed £35.00 a month for each property for nothing. He was displaying the Logo of the PRS, CMP, etc. on his website and the letterheads but on checking his credentials, I found out that he was not a registered letting agent of any. So, I reported him to the local Trading Standards but they didn't reply to me. Soon after, he became a member of TPO.
He promised to send me the tenant's documents such as the AST but under one excuse or the other, he never sent me. He asked me to get the ICO Certificate before he will do so, which I did in August 2021 and still, nothing was sent to me but fake emails the documents have been posted. On knowing that he is displaying fake Logos, I took the properties off his hands.
I have reported him to the ICO office for not sending the documents to me or my new Estate Agent who wants to sell my property and needs those documents. He has refused to send him either.
My daughter wrote him a letter to do so under the ICO terms but no reply. The TPO also asked him to do so but he made false statements that he will send them recorded delivery but none were sent. The TPO told me that they have no punitive powers to force him to send the documents to them or to me but recommended that I should contact the National Trading Standards office in Bristol, which I have done.
The NTL Trading Standards Office, Bristol told me to contact the ICO Office again, which I have done but still, no reply or action was taken by the ICO Office as if they have no punitive powers either.
In short, this Letting Agent is holding me at RANSOM demanding money of £75.00 for the documents which I had already paid him to prepare the documents.
Fortunately, my tenant has given her documents to my Estate Agent selling my properties.
Can I claim the fees he had charged me whilst being not registered to operate as a letting agent?
