I have a property that is managed by an agent and the tenant who left with rent arrears and property damaged had their deposit returned in full through TDS.

This was due to a gap between when the check-in report was carried out and when the tenancy agreement eventually started (a week later), despite the tenant requesting to move in later due to not paying deposit or rent on initial move in date. We have tried to dispute it but TDS are saying a week is too long so they cannot validate the state of the property at the start of the agreement.

Where do I stand? We have tried disputing it but their decision did not change. Additionally, what is the best way of ensuring the tenant receives/acknowledges the check-in report (again they claimed they did not receive it.

Agent claims they did everything they could and it is TDS fault and are shocked at the results. They want to write to TDS and get further explanation.
