Recently I formally evicted a problem tenant. The court granted me a Writ of possession & control identifying £6k+ of debt to be paid (rent arrears and fixed fees). I had intended to claim part of this amount from the tenancy deposit. This would still leave a significant shortfall to be pursued. I am also now getting other bills for getting my property up to the same standard as it was when the tenant first moved in. However, I have heard rumours that by claiming the deposit in part payment of a court order I can jeopardize my claim for the remaining amount?
If this is the case it seems to imply that the tenant’s deposit can in effect only be used for a claim towards rectifying the damage caused during the tenancy even though this additional amount cannot be identified until possession had been regained.
Has anyone had any experience of this?
