Keeping deposit for rent arrears - Yes or No?

I am in the process of issuing a section 8 and 21 to my nightmare tenant who is basically refusing to pay rent and has stated she will stay there rent free for a year until the bailiffs evict her!

She is also playing the mental health card!

I protected her deposit but stupidly done it 40 days after receiving it as we had a delay in getting the GSC done which delayed the moving in date.

Would you refund the deposit back to her now or deduct it off the current arrears which will be 3 months very soon?
