Pay Down before court hearing

The NRLA want these grounds:-
Published our shadow white paper, A New Deal for the Private Rented Sector,

It reads;
“The tenant is in arrears of at least 2 months
of rent at the time a notice to repossess is
served and in arrears of more than 1 month
by the time of a court hearing”

I strongly object to the Pay Down i.e. The tenant can make a payment (say 1 day before the court hearing) so as to bring the amount below 1 month.

Does this mean, I pay £398.00 for the court and then the tenant Pays Down and I loose £398.00 and I’ve gone through REAL stress for months waiting for the hearing?

Also, this can happen a few times, say twice a year.

This is like The Tenant having free rein on my bank account.

I can’t work with the Pay Down.
