Dear Forum,

One of my tenants concedes that her children have caused damage to her tenanted property over and above normal wear and tear. The walls have been badly marked by dirt and crayon drawings, the plastic finish to several kitchen cupboard doors has been partly stripped away, a door knob has been wrenched off, garden fencing destroyed...etc etc. We hold the maximum tenancy deposit but this will not nearly cover the overall cost.

Sensibly wary of eviction, the tenant has offered to cooperate with an interim inventory of the damage caused to date and - crucially - sign an admission of liability for future adjudication of our claim against her deposit.

She has also offered either to arrange for the necessary repair work done herself or by direct payment interim payment in order for us to arrange this.

Would acceptance of our tenant's offer of interim restitution be permissible under tenancy deposit regulations?
