Hello, 

I have a tenant with a lung condition and they claim PIP for it. They say it's a physical disability.

I issued a S21 notice and afterwards, they complained about a bug issue, such as spiders, small flies etc.

I have gotten 2 different pest controllers out and none of them suggests there is big pest issue. The first one said there were stored food insects, and the second said there were dust mites. The first said the flat was untidy and unclean, the second said the flat was very dusty in areas. The 2nd pest controller did a spray treatment and a 2nd one was due. However, the tenant has got a solicitor (legal aid) that said I need to provide alternative accommodation for the 2nd spray as the chemicals puts the tenant in health danger (worse case death) due to their health condition. They told me that as a private landlord, I do have the responsibility to make reasonable adjustment for the physical disability.

 

They have suggested either alternative accommodation or no rent to be paid for the period the chemicals are present. This might be around 2 weeks as pest controller's have said to leave not clean the property for 2 weeks. 

 

I wanted to check with people here what I need to do because I had gotten advice that I didn't need to provide any provisions for a tenants' health conditions, but now I'm told I do. I'm not sure if it's because the health condition makes them a disabled person that I need to make the provisions?
