Gifted property with outstanding mortgage

I think this is simple but the solicitors don't.

We are being gifted a property

We already own 5 BTL'S

We don't own our own property.

We won't be living in the gifted property either.

 

The question is regard to stamp duty.

The solicitor states duty is payable on the value of the property. 300k.

I say as it's gifted and with a mortgage, the duty is payable on the 93k.

That's what I read from HMRC.

Despite me constantly querying with solicitors, they are adamant I'm wrong and just tell me to speak to HMRC.

Someone tell me I'm not mad.

And that I am reading it right
