Hi All,

I have served Section 21 Notice on my tenant who was an existing tenant but refued to sign a new ASTA since I purchased the property just over a year ago. I attempted to sign the agreement and I used a standard agreement template and amended the daft following requests to make the amendments by the tenant on at least a couple of times but in the end the tenant refused to sign it. Now the notice period has expired, and  to pursue a Court order, do I still need to use Forms N5 and N119 instead of Form N5B? which means a need for a Court Hearing rather than an accelerated route? My point here is that the guidance states if copies of the agreemnt cannot be presented then Forms N5 and N119 must be used. In my case I can present the draft copies with Tracked Changes and Clean copies backed by exchange of emails but obviously they are not signed because the tenants refused to accept the GDPR Clause.
