Drain pipe damage from tree from another propery

We own a (leasehold) flat in a house of two flats, the other one doesn't belong to us. The drains are blocked approximately twice a year and we have to sort this out, with the other owner. We had it investigated and it seems like a large tree on the next property damaged the drains and that's why we have this problem. Has anybody been in this position?
