We have a tenant under notice of possession who thought it was a good idea to take us to court on 20th December with a spurious claim against us saying he hadn't agreed to a Consent Order from his solicitor from July last year. He should have moved out in October and pay rent in the meantime but didn't. We are awaiting bailiffs (due on 6th March). The judge told him his solicitor was his representative and he must take up any complaints with him and the Consent Order still stood. His solicitors had withdrawn and he had lost legal aid so funded by the rents he had saved by not paying for a year. The judge mentioned that if he did not allow for our inspection under the terms of our insurance policy nor allow a gas safety inspection (due last November) then he could be fined and mentioned an amount of £400 plus. Has anyone any experience of this as we would like to pursue it as it will inevitably be our problem should any accidents happen?
