Is it legit to decline tenant on bank statements?

Hi, 

Having previously asked prospective tenants whether they have adverse credit before referencing (only to find out from referencing that they do) I now ask to see bank statements before putting them through referencing. I have a tenant who wishes to proceed with the application - affordability is technically good but their bank statements shows they consistently live in their overdraft and sometimes spend marginally beyond their agreed limit. I am planning on declining them for this reason - is this in any way discriminatory?
