A tenant has been given a section 13 rent increase form in December for rent increase effective 1st February 2024.  A section 13 was issued because she refused the rent increase.

The tenant has arrears and also pays her rent late each month.

The breathing space info says a tenant has to continue to pay their usual rent when they have been awarded a breathing space.

If the tenant is awarded a debt resolution breathing space, can they continue to pay the old rent on the grounds that they haven't yet paid the rent at the new rate.  

Or will they still be obliged to pay the new rent because the section 13 was given before the breathing space was awarded.
