Who pays for check out report

Hi there

I rented a house to some tenants 3 years ago. Under the terms of the lease it stated that they were due to pay for the check out report - since then the rules of course have changed but my agent advised that as the tenancy was an historical one then the tenants are still liable. They have recently moved out.
