I have a bad problem with anti-social behaviour in the flat which I rent out. My tenant is a single mother with two young children, one a baby. The main culprit is the tenant's boyfriend, who neighbours tell me is a violent and threatening individual. As he isn't a tenant, I feel powerless to deal with him. However my tenant is also culpable to a lesser extent. Neighbours have alleged that both of them are involved in alcohol and possibly drug abuse.
The police have been called during the lockdown approximately 20 times due to late-night arguments between the tenant and her partner. As it's in a block of flats, the noise, shouting and objects being thrown cause a lot of disruption to other residents. I'm getting complaints both from other residents and the management company.
Last weekend the partner was arrested by the police after he attacked my tenant and she ended up in hospital with concussion. My tenant alleges that she's now got an injunction against the partner to stop him approaching her. I don't know whether this is true or not. Is there any way for me to see whether there really is an injunction in force? Do I have the right to ask the police about it? My biggest fear, and that of the neighbours and the management company, is that there's yet another reconciliation and this partner moves back into the property.
I should add I issued a Section 21 in September with 6 months notice due to coronavirus rules. I was advised that it's very difficult to evict on the grounds of anti-social behaviour without significant rent arrears as well, and these arrears are under 2 months. However, I feel I may have to do more, as things are getting out of hand. I'm in quite a difficult situation and any advice would be very welcome!
