I have the freehold of a house but the 1st floor flat is owned by a peppercorn rent leaseholder. As per leasehold agreement the leaseholder is responsible for the upkeep of the roof. Now the gutter needs some maintenance work but the leaseholder is arguing that the guttering is not part of the roof. Who is responsible for the repair?
