DWP Tenant Refusing to Pay Rent

Dear Advice Team and Forum,

We have a DWP tenant (classed as "vulnerable") without any direct rent payment arrangement.

This tenant has previously attempted a fraud at our expense in respect of some redecoration monies, which attempt we forgave on account of her vulnerability.

However, the tenant is now minded to leave.

Because of our caution in issuing a landlord reference on her behalf, the tenant attempted a second fraud (uncovered by the tenant referencing company concerned) by giving her boyfriend contact details as her existing landlord.

She has now announced that she will not deal with us further and - by inference - will stay on in the house without paying rent, until evicted. There are repairs to be done at the house which we are willing to undertake but we believe that she will deny us access to address them in order to cite those repairs as justification for her "rent holiday".

Is the DWP under any statutory duty to instigate a direct payment arrangement 1) immediately, given that we have text evidence and a third party witness to both frauds 2) after two months arrears have been accrued ditto?

If two months arrears, does that refer to two missed monthly payments ie 01/03/21 for March and 01/04/21 for April (meaning that we could apply to DWP for direct payment on 02/04/21) or two months worth of rent (meaning that we would have to wait until 01/05/21?

Do we have the right to notify her council social worker under GDPR regulations?

Do any forum members have direct experience of this type of situation, or elements of it?

Please advise us urgently.
