Good morning, I drew up an Assured Shorthold Tenancy Agreement - Provided under part 1 of the Housing Act 1988 and amended under part 3 of the Housing Act 1996 from your website in Dec 20.
Although I am being paid the rent as per contract via UC, the tenant isn't paying me the verbal rent (Top-up) which I should have put on the Tenancy agreement at the onset, my mistake but gullible I am . Also I made the contract for 24 months as requested by the Council who arranged the tenant's first month rent and deposit.
The tenant says she doesn't have a phone since January, I send her emails which she says she views on daughter's phone but doesn't respond to any
Last time I went round, she said 'she doesn't have the money and to give me a FXXX notice'. She said that numerous times and was aggressive in her tone.
I haven't done a property inspection yet and don't believe she will give me access either.
Her neighbours have complained to me of tenant's dog going into their garden and also of keeping chickens. All this without my consent or knowledge. Also smelling pot and flies from rubbish left by the side of the house. She also has a large sofa dumped in the front garden for a couple of months now
I dread to think what the state of the property is as I saw dog ends on the floor just inside the door when I visited.
She runs a business, has young children etc so how can she not have a phone.??
Please advise what process I can follow to get her out of there, this is a very stressful time for me and have never had to deal with people of this nature. Thank you
