I have joint tenants one of whom went missing early Oct. Fortunately I took 2 months rent in advance as per RLA agreement and so he was not actually in arrears until 15th Nov when next rent was due. The remaining tenant says she can only pay her half and did so 15th Nov. I have advised that because of 'joint & individual' clause, I am now using her advance rental to pay for absentee tenant up until 15th Dec. My question is this:
1)Are they 2 months in arrears now because they have broken the terms of the contract even though I am not actually out of pocket?
2)What can I do if remaining tenant just pays her half of rent?

The AST expires 14th Mar 2009 & I have already issued a S21
