I let a flat through an agent in Liverpool, as part of their contract they are meant to do a full credit check on any prospective tenants and arrange for a guarantor if deemed necessary. I recently had a tenant who failed to pay any rent for six months. When we finally evicted the tenant it turned out that they hadn't got the signature of a guarantor, due to the negligence of one of their staff. This member of staff has subsequently been dismissed. Do I have any recourse against the agency for negligence?
