I have a tenant for whom I receive Housing benefit paid throught the Credit union system. The tenant paid a bond for the property and 4 weeks rent in advance in full personally. Every 4 weeks I collect the rental top up due from the tenant of approx £70. I have not had payment from the tenant for the past 3 due dates. Can I seek possession of the property under section 8 now. The tenant is over the 8 weeks period but I am unsure as to how I stand legally regarding the advance rent I collected initially. The advance is 440 and the debt to date is 228. Help please.
