All S21 notices after 6th April 2007 can only be served if the tenancy deposit has been put into a scheme.
Where the notice has been issued before the deposit was taken after 6th April 2007 ( or an older deposit renewed after that date) then the notice cant be issued until the deposit is in a scheme
