My tenant is in prison, he is £3000 in arrears, would not end his tenancy agreement, so I served notice with a section 8, on 1st May 2010. I have heard nothing from him, so applied for a court date and got it for 22nd July 2010. The last drive by check two weeks ago showed all his belongings were still in the house. His father said he was not prepared to move any of his things. Today was the last day of the S8 notice. The house is empty. The keys have not been left. There is a small amount of damage and a few things missing.
Can i presume that the house is back in my possession again? Am i able to change the locks? Do i still need to go to court?
Many thanks
