If the fixed period ended 16/1/11, the rent has always been paid monthly 1st of each month.

The periodic then should run from the 17/1/11 to the 16/2/11 then 17/2/11 to the 16/3/11 thereafter repeating each month until he leaves.

So, if i serve notice on the 13th June 2011, surely the date he should leave is actually the 16/8/11 which takes him to the end of the month for his periodic rent ie 16/6/11 then two full months which would be 17/6/11 to 16/7/11 then 17/7/ to 16/8/11 hence he leaves 16/8/11

If i served notice 18/6/11 then the date for him to leave would be the 16/9/11.
Am i right or totally wrong, i cannot see where you got 31st August from. Finally if he is away in USA does leaving notice at flat count as being served even though i know he is away
