Further to my e-mail earlier this week regarding a joint tenancy where one of the parties wishes to be removed from the tenancy.

I took the couple named in the original tenancy agreement as tenants before the deposit schemes came into force so the current deposit is not protected. Do I have to draw up a new tenancy in the remaining tenants name thereby giving them a new six month AST during which I cannot give notice and which in turn requires the existing deposit to be protected under the deposit scheme rules ?
