I recently bought a house with an existing tenant from a friend. I have tried to negotiate a new tenancy agreement with her but unfortunatelt she is not prepared to discuss this or pay any rent.

I have only just found out from my friend that he has no tenancy agreement but the tenant had agreed to pay £500 per month which he collected. I also on two separate occassions collected money from this tenant on behalf of my friend last year.

The tenant has been in the property for over a year.

My friend will be prepared to attend court or provide a signed declaration of giving this proerty to her.

I bought the property on 17th May 2007.

Can you please advise what my legal position in view of bringing a possession hearing.
