Tenant ignoring terms of Tenancy Agreement regards payment of Rent

We have a tenant that has no regard for the contents of their Tenancy Agreement, wish to pay in arrears rather than in advance (as per the Agreement) and now is demanding (threatening) the repayment of their first advance payment.

Are we in our right to give notice to evict?
What minimum notice can be given?

Please advise.
