My parents let a flat on 18 June 2006 to a couple who paid a deposit of £535. On 11 April 2008 the property title was transferred to myself, no new tenancy agreement was set up, a letter was sent to the tenant asking them to pay my account direct in the future.

The property has been damaged by condensation caused by the tenants who state it is due to water leaking from the flat above.

The tenants moved out on 5 July 2010 and are demanding the deposit be returned or they will sue for not securing the deposit.

Should the deposit have been secured by myself on the transfer in April 2008?

What is the position given there was no tenancy agreement between myself and tenants?
