Landlords often wonder if rent is due from the tenant after a section 21 notice expires, possession is sought and the tenant remains in the property. The simple answer is ‘yes’, they will remain liable for rent. Service of a section 21 notice does not alter the tenant’s liability to pay rent. Strictly speaking, the rent should be received as ‘mesne profit’.
