I have a 12 month AST (6 month break with 2 months' notice) which is due to expire shortly. My tenant would prefer not to commit to another 6 months but is happy to continue with 2 months' notice from both sides.

I don't want the tenancy to become periodic as there are details in the current agreement that need amending and, in any case, I want the security of 2 months' notice.

Therefore, I propose renewing the 12 month AST which gives my tenant a guaranteed 6 months, but allowing him to break after only 2 months. Will an AST with this style of break clause be lawful?
