Tenant threatening court action

I served a section 21 on a tenant who eventually after the notice had expired sent me an email saying he had moved everything out and cleaned, but when I went in to start painting found he had moved nothing and left a digesting mess. I moved all his stuff onto the pavement and told him to move it. He is now threatening to take me to court. As I have it in writing that he had left can he do that? He was 6 months behind with the rent, and spent all the housing benefit money an a month long holiday!
